Data Protection Policy

The Upper Austrian state administration respects the privacy of citizens and their customers.

All information (data) that we receive will be treated confidentially in accordance with the applicable data protection regulations and will not be passed on to third parties unless we are legally obliged or authorised to do so or this is done with your consent or on a contractual basis.

All information is only processed for specific legitimate purposes.

We take appropriate measures to ensure the security and protection of the processed data.

3. Information pursuant to Art. 13 f of the General Data Protection Regulation

General information

If no further information is provided on the legal basis of our processing, the following apllies:

Consent is obtained based on Art. 6 (1) lit. a and Art. 7 f GDPR. Consent can be revoked at any time without giving reasons. The legality of the data processing carried out until the revocation remains unaffected by the revocation. After cancellation, the data will no longer be used for the purpose for which consent was given (e.g. sending an e-mail newsletter).

Data processing for pre-contractual measures and the fulfilment of contracts is carried out based on Art. 6 (1) lit. b GDPR. The fulfilment of legal obligations and the enforcement of legal provisions are based on Art. 6 (1) lit. c and e GDPR. Insofar as processing is necessary for the purposes of our legitimate interests or those of third parties, this is based on Art. 6 (1) lit. f GDPR.

Photos taken at events are published for public relations purposes and to present our activities on the website of the Upper Austrian state administration, on the websites of the Upper Austrian Music School Association (“Oö. Landesmusikschulwerk”) or the relevant provincial music schools and occasionally in print media and social media (legitimate interest).

Pursuant to Art. 15 et seq GDPR, there is a fundamental right to access, rectification, erasure, restriction of processing, objection and, in certain cases, to data portability, provided there are no legal grounds to the contrary.

The retention period of the individual data processing operations is determined either by special legal provisions or by the respective archiving regulations. In accordance with § 3 Upper Austrian Archive Act (“Oö. Archivgesetz”), the Upper Austrian provincial administration must offer all documents that it no longer requires on a permanent basis to the Upper Austrian Provincial Archives (Oö. Landesarchiv) for transfer (verification of archival value) after the expiry of a period specified by the organisational regulations (archiving regulations) or after 30 years at the latest (maximum periods).

The competent authority for data protection complaints is the Austrian Data Protection Authority (www.dsb.gv.at).

4. Right to object pursuant to Art. 21 GDPR

The data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Art. 6 (1) GDPR, including profiling based on those provisions (Art. 21 (2) GDPR). Pursuant to Art. 21 (2) GDPR, there is also a right to object to direct marketing.

Please note that an objection is not or cannot be effective if the data processing is necessary for compelling legitimate reasons.

5. Use of analysis tools

Matomo is used on this website for statistical analysis. The IP addresses recorded with it are anonymised immediately. This means that no personal data is stored for statistical analyses. By analysing the anonymous data, user needs can be identified and the quality of the service can be improved. The programmes used are hosted on servers of the Office of the Upper Austrian Provincial Government.

6. Server Logs

Each of your accesses is stored in a log file (server logs) for a limited time with the following data.

  • IP address
  • Date and time
  • Called link and called method
  • http status and file size
  • Refferrer (Internet address of the website from which the visitor comes)
  • User agent or browser of the user
  • Query string

This data is used exclusively to check system security. No personal evaluation or profiling takes place. Nevertheless, we reserve the right to analyse your IP-address in the event of attacks on our services.
